Artificial Intelligence in Islamic Law: Ethics, Governance, and Accountability

Abstract:

Muslim countries increasingly adopt Artificial Intelligence technologies, creating challenges related to accountability, explainability, discrimination, and oversight, while existing regulatory frameworks remain insufficient to govern high risk Artificial Intelligence systems comprehensively. This study examines the regulatory shortcomings of Artificial Intelligence governance in selected Muslim countries and formulates an Islamic governance framework based on the principles of Maqāṣid al Sharīʿah. The study applies normative legal research through statutory, comparative, and Islamic legal philosophical approaches to evaluate existing regulatory models and identify normative gaps. The analysis demonstrates three principal findings. First, existing regulatory frameworks do not adequately regulate explainability standards, algorithmic auditing mechanisms, judicial review procedures, and legal liability for automated decisions. Second, the widespread use of opaque algorithmic systems in digital surveillance, financial technology, and public administration increases the potential for indirect discrimination, unequal legal relationships, and disproportionate exercises of discretionary authority. Third, the principles of if al ʿaql, if al māl, and if al ʿird establish normative foundations that support explainability, meaningful human oversight, privacy protection, and economic justice within Artificial Intelligence governance.

Enas Qutieshat, Faculty of Law, Sohar University, Sohar

Dr. Enas Qutieshat is an esteemed academic and legal scholar holding a Ph.D. in Law from the University of Aberdeen, UK. She currently serves as Dean of the Faculty of Law at Sohar University, Oman, where she leads curriculum development, accreditation processes, and innovative approaches to legal education. Previously, she served for eight years as Deputy Dean and Head of the Law Department at Philadelphia University, Jordan, gaining extensive experience in academic leadership and institutional management. Promoted to Associate Professor in 2020, Dr. Qutieshat’s research and professional contributions span public law, women’s rights, and the legal regulation of emerging technologies, with a strong commitment to advancing quality in higher education.

 

Majed Al Adwan , Faculty of Law, Sohar University, Sohar

Dr. Majed Al Adwan is an Associate Professor of Administrative Law at the Faculty of Law, Sohar University. He holds a PhD in Administrative Law from the University of Jordan. He previously served as an Associate Professor at Taibah University (Saudi Arabia) and Amman Arab University (Jordan). His research interests include Administrative Judiciary, Administrative Law, Administrative Contracts, Financial Law, and Constitutional Law. His work has been published in peer-reviewed academic journals, with a focus on doctrinal and judicial analysis.

 

Maya Khater, College of Law, United Arab Emirates University, Alain

Maya Khater is an Associate Professor of Public International Law at the College of Law, United Arab Emirates University (UAEU). She holds a PhD in Law from the Faculty of Law at Damascus University, awarded in 2011. Before joining UAEU, Dr. Maya worked as a Lecturer at the College of International Relations and Diplomatic Sciences at Al Kalamoon University in Syria and later as an Assistant Professor at Dar Al Uloom University and an Associate Professor at Al Yamamah University in Saudi Arabia, as well as Abu Dhabi University in the United Arab Emirates.

Throughout her career, she has held several academic and administrative positions, including Vice Dean for Admission, Registration, and Student Affairs, Assistant Dean of the College, and membership in numerous academic and institutional committees. Dr. Maya has taught a wide range of law courses in both Arabic and English, supervised and examined master’s and PhD theses and research projects, and reviewed books and articles for legal journals. She has authored four books and published numerous research papers in high-ranked journals, including those indexed in Scopus and the Web of Science.
